TERMS AND CONDITIONS OF HIRE

Total capacity (Hall and Supper Room) is 128 people, seating 100 in the main hall. The Hall is licensed for music until 11pm so all music must stop then and the Hall vacated by midnight. Noise levels must be kept to a minimum on arrival and departure, with particular consideration late at night. Dacre Hall is a NO SMOKING facility, including downstairs (ie hallway, toilets and cloakroom). The consumption of alcohol is NOT permitted outside Dacre Hall. If you wish to sell alcohol, an appropriate licence needs to be procured by the hirer and a copy sent to the Dacre Hall Secretary. Dacre Hall is a listed building. NOTHING should be affixed to the stone walls or any other structure, including (but not limited to) tape, blue tack, pins, hooks, adhesives. The Hall and surrounding area are to be left in the same condition as they were at the beginning of hire. Dacre Hall accepts no liability for personal injury, loss or damage to personal property in the course of or caused by the occupation of the premises. Keys will be provided for the period of hire, which are your responsibility whilst in your possession. Hire instructions will be provided and an end of hire checklist which must be completed and signed at the end of your hire period. A pre-existing arrangement with the Priory and English Heritage means that when the Hall is hired out, English Heritage staff and those attending church services and other events must still have access to the toilets, which are on the ground floor (Standard Conditions of Hire number 25). A deposit is payable in respect of wedding or full day hire, invoiced when we receive your completed booking form (Standard Conditions of Hire number 19). The Dacre Hall Secretary collects and processes names and contact details of hirers and those making booking enquiries. This information is provided directly by you in order that we can communicate with you about your request. It is kept securely and may be viewed by certain members of the Dacre Hall Committee, but is not shared with any other organisation.

STANDARD CONDITIONS OF HIRE

These Standard Conditions apply to all hiring of the Dacre Hall. If you are in any doubt as to the meaning of the following, the Hall Secretary should be contacted immediately.

1. Supervision You shall, during the period of the hiring, be responsible for the following: a. supervision of the premises, the fabric and the contents; their care, safety from damage however slight or change of any sort b. the behaviour of all persons using the Dacre Hall, whatever their capacity c. proper supervision of car parking arrangements so as to avoid any obstruction of the highway or garth As directed by the Hall Secretary, you shall make good or pay for all damage (including accidental damage) to the Dacre Hall and surrounding area or to the fixtures, fittings or contents and for loss of contents.

2. Use of the Dacre Hall You shall not use the Dacre Hall for any purpose other than that described on your Booking Form and shall not sub-hire or use the Dacre Hall or allow it to be used for any unlawful purpose or in any unlawful way nor do anything or bring into the Dacre Hall or surrounding area anything that may endanger the same or render invalid any insurance policies in respect thereof.

3. Gaming, Betting and Lotteries You shall ensure that nothing is done on or in relation to the Dacre Hall in contravention of the law relating to gaming, betting and lotteries.

4. Licences The Dacre Hall holds a Performing Society Rights Licence and a Phonographic Performance Limited licence which permits the use of copyright music in any form, e.g. record, compact disc, tapes, radio, television, or by performers in person. If other licences are required in respect of any activity in the Dacre Hall you should ensure that they hold the relevant licence.

5. Public Safety Compliance You shall comply with all conditions and regulations made in respect of the premises by the Fire Authority, Local Authority, the Licensing Authority or otherwise, particularly in connection with any event which constitutes regulated entertainment, at which alcohol is sold or provided. You shall acknowledge that they have received instruction in the following matters: a. the action to be taken in event of fire, which includes calling the Fire Brigade and evacuating the Dacre Hall b. the location and use of fire equipment c. escape routes and the need to keep them clear d. method of operation of escape door fastenings e. appreciation of the importance of any fire doors and of closing all fire doors at the time of a fire In advance of an entertainment or play you shall check the following items: a. that all fire exits are unlocked and panic bolts in good working order b. that all escape routes are free from obstruction and can be safely used c. that any fire doors are not wedged open d. that exit signs are illuminated e. that there are no obvious fire hazards in or around the Dacre Hall

6. Means of Escape All means of exit from the Dacre Hall must be kept free from obstruction and immediately available for instant free public exit. The emergency lighting supply illuminating all exit signs and routes must be turned on during the whole of the time the Dacre Hall is occupied.

7. Outbreaks of Fire The Fire Brigade shall be called immediately to any outbreak of fire, however slight, and details thereof shall be given to the Hall Secretary.

8. Health and Hygiene If preparing, serving or selling food, you shall observe all relevant food, health and hygiene legislation and regulations. In particular dairy products, vegetables and meat in the Dacre Hall must be refrigerated and stored in compliance with the Food Temperature Regulations. The Dacre Hall provides a refrigerator.

9. Electrical Appliance Safety You shall ensure that any electrical appliances brought by you to the Dacre Hall and used there shall be safe, in good working order, and used in a safe manner in accordance with the Electricity at Work Regulations 1989. All appliances must be subject to a Portable Appliance Test (PAT). Where a residual circuit breaker is provided you must make use of it in the interests of public safety.

10. Indemnity You shall indemnify and keep indemnified each member of the Dacre Hall Management Committee [the Committee] and the Dacre Hall’s employees, volunteers, agents and invitees against: a. the cost of repair of any damage done to any part of the Dacre Hall including the cartilage thereof or its contents b. all claims, losses, damages and costs in respect of damage or loss of property or injury to persons arising as a result of the use of the Dacre Hall (including the storage of equipment) by you c. all claims, losses, damages and costs suffered or incurred as a result of any nuisance caused to a third party as a result of the use of the premises by you.

11. Accidents and Dangerous Occurrences You must report all accidents involving injury to the public to a member of the Committee as soon as possible and complete the relevant section of the Dacre Hall’s accident book. Any failure of equipment belonging to the Dacre Hall or brought in by you must also be reported as soon as possible. Certain types of accident or injury must be reported on a special form to the local authority. The Hall Secretary will give assistance in completing this form, if necessary. This is in accordance with the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 (RIDDOR).

12. Explosives and Dangerous Occurrences You shall ensure that: a. highly flammable substances are not brought into, or used in any part of the Dacre Hall b. no internal decorations of a combustible nature (e.g. polystyrene, cotton wool) shall be erected without the consent of the Committee. No decorations are to be put up near light fittings or heaters.

13. Heating You shall ensure that no unauthorised heating appliances shall be used in the Dacre Hall without the written consent of the Committee. Portable Liquefied Propane Gas (LPG) heating appliances shall not be used.

14. Drunk and Disorderly Behaviour and Supply of Illegal Drugs You shall ensure that in order to avoid disturbing neighbours of the Dacre Hall and avoid violent criminal behaviour, care shall be taken to avoid excessive consumption of alcohol. Drunk and disorderly behaviour shall not be permitted either in the Dacre Hall or in its immediate vicinity. Alcohol shall not be served to any person suspected of being drunk nor to any person suspected of being under the age of 18. Any person suspected of being drunk, under the influence of drugs or who is behaving in a violent or disorderly way shall and must be asked to leave the Dacre Hall. No illegal drugs may be brought into the Dacre Hall or surrounding area.

15. Animals You shall ensure that no animals (including birds) except Guide Dogs are brought into the Dacre Hall, other than for a special event agreed to by the Committee. No animals whatsoever are to enter the Supper Room at any time.

16. Compliance with Child Protection Legislation You shall ensure that any activities for children comply with the provisions of The Children Acts 1989, 2004 and subsequent updates and that only fit and proper persons who have passed the appropriate Criminal Records Bureau checks have access to the children (checks may also apply where children over eight and vulnerable adults are taking part in activities). You shall provide the Committee with a copy of your Child Protection Policy on request.

17. Fly Posting You shall not carry out or permit fly posting or any other form of unauthorised advertisements for any event taking place at the Dacre Hall, and shall indemnify and keep indemnified each member of the Committee accordingly against all actions, claims and proceedings arising from any breach of this condition. Failure to observe this condition may lead to prosecution by the local authority.

18. Sale of Goods You shall, if selling goods in the Dacre Hall, comply with Fair Trading laws and any code of practice used in connection with such sales. In particular, you shall ensure that the total prices of all goods and services are prominently displayed, as shall be the organiser’s name and address and that any discounts offered are based only on Manufacturer’s Recommended Retail Prices.

19. Cancellation If you wish to cancel the booking before the date of the event any deposit paid will not be refunded. If the Dacre Hall is unable to secure a replacement booking, payment of outstanding hire fees shall be at the discretion of the Committee. The Committee reserves the right to cancel this hiring by written notice in the event of: i. the Dacre Hall being required for use as a Polling Station for a Parliamentary or Local Government election or by-election ii. the Committee reasonably considering that: a. such hiring will lead to a breach of licensing conditions, if applicable, or other legal or statutory requirements b. unlawful or unsuitable activities will take place at the Dacre Hall as a result of this hiring c. the Dacre Hall becoming unfit for the use intended by you d. an emergency requiring the use of the Dacre Hall as a shelter for the victims of flooding, snowstorm, fire, explosion or those at risk of these or similar disasters In any such case you shall be entitled to a refund of any deposit already paid, but the Committee and the Dacre Hall shall not be liable to you for any resulting direct or indirect loss or damages whatsoever.

20. End of Hire You shall be responsible for leaving the Dacre Hall and surrounding area in a clean and tidy condition, properly locked and secured unless directed otherwise and any contents temporarily removed from their usual positions properly replaced, otherwise the Committee reserves the right to make an additional charge. You should refer to any instructions and checklist provided.

21. Noise You shall ensure that the minimum of noise is made on arrival and departure, particularly late at night and early in the morning. You shall, if using sound amplification equipment, make use of any noise limitation device available to you and comply with any other licensing condition for the Dacre Hall.

22. Stored Equipment The Dacre Hall accepts no responsibility for any stored equipment or other property brought into or left at the Dacre Hall, and all liability for loss or damage is hereby excluded. All equipment and other property must be removed at the end of each hiring, or fees will be charged for each day or part day at the hire fee per hiring until the same is removed. If you have not removed such equipment or property within seven days of the end of the hire period, the Committee reserves the right to dispose of any such items by sale or otherwise on such terms and conditions as it thinks fit, and charge you any costs incurred in storing, selling or otherwise disposing of the same.

23. No Alterations No alterations or additions may be made to the Dacre Hall nor may any fixtures, placards, decorations or other articles be installed or attached in any way to any part of the Dacre Hall or the surrounding area without the prior written approval of the Committee. Upon removal you must make good to the satisfaction of the Committee.

24. No Rights The Hiring Agreement constitutes permission only to use the Dacre Hall and confers no tenancy or other right of occupation on you.

25. Use of Toilets When Dacre Hall is hired out, there are pre-existing agreements to provide use of their toilet facilities with: a. Lanercost Priory for those attending church services, weddings, concerts, and other events b. English Heritage for their employees during their opening hours.
